Alternative Dispute Resolution

As the new year approaches it is a time for reflection and resolutions.
If you are in a family law case or if you are contemplating being in one, you should seriously resolve to consider alternate forms of dispute resolution for your case.
We often hear that lawyers prolong the litigation for financial gain. By and large this is not our experience. In fact, the lawyers we work with are always looking for alternative ways to resolve disputes. It is simply easier financially and emotionally to resolve disputes by avoiding litigation.
Three common forms of alternate dispute resolution are arbitration, mediation and collaboration. They each have their strengths and weaknesses and should be tailored to a specific case, but they are all worth exploring. Without doubt, many, many cases can be resolved through one of these methods, rather than the time and expense involved in traditional litigation.
If your lawyer does not raise the issue of alternate dispute resolution with you, you should raise the issue with him or her and find out which method(s) would be best for your case.
