Filing Your Taxes While Divorce Pending

While a divorce is pending, it is very important that both parties consult with a certified public accountant (CPA) to determine the best way to file their federal and state taxes (whether the parties wish to file married separate, married joint, etc., for example). Most family law attorneys are not qualified to give tax advice unless they have special training as a tax attorney, or as a certified public accountant. The parties need to cooperate so as to not accidentally cause a tax problem that may or may not trigger an audit or minimally cause either or both to incur penalties for not paying your taxes on time. It is foolish to just assume that the way you want to file is the best way while the divorce is pending.
