Divorce and Auto Insurance

Most families have one auto insurance policy that insures all members of the family and all the cars in order to benefit from multi-vehicle discounts. However, once parties separate and prepare to divorce, it is vital to discuss your auto insurance needs with your agent because once you are divorced and no longer living together, you cannot be insured under the same auto policy. Issues to discuss include joint custody of teenage drivers, auto insurance discounts, changes such as becoming a primary driver instead of secondary, cost of individual coverage, effect of former spouse's credit on your insurance application, whether you should shop around for a new auto insurance company, whether your spouse can unilaterally drop you from an auto policy before you are divorced, and who "owns" the policy. It is prudent to talk to your agent as soon as a divorce is filed as well as your attorney about insurance issues. An attorney can obtain a temporary restraining order, for example, restraining a spouse from terminating your coverage during the divorce process. This is a very common concern and issue in divorce.
