Life Insurance Policies and Divorce

Many individuals have life insurance policies provided as an employment benefit or you may have purchased individual policies during the marriage. When you are married, you usually name your spouse as your beneficiary of the policy proceeds if you die. This makes sense in order for your family to have a source of funds to help replace your income. However, when parties divorce, most people no longer want their former spouse to be the beneficiary of the life insurance. It is important to review beneficiary designations during and after your divorce. Divorcing parties need to consider who should benefit from your life insurance. Often, during the divorce, one spouse asks the Court to order that they remain as benefiicary as security for a maintenance obligation (also known as spousal support) or as security for child support until the children are grown.
